Introduction
These Terms of Service apply when you create an account, access, or use ELM, Viewsly, ELM.social, or any application, service, or platform developed or operated by ELM-HQ (together, the "Services").
By using the Services, you agree to comply with these Terms. If you do not agree, you must not use the Services.
Eligibility
You must be at least 13 years old, or the minimum age required by the laws of your country, to use the Services.
Some areas of the Services, including 18+ Spaces or other restricted content areas, may require you to be 18 years of age or older. By entering or using those areas, you confirm that you meet the required age.
Accounts
To use the Services, you may need to create an account identified by an ELM PIN or another system-generated identifier, depending on the application.
You are responsible for maintaining the security of your account and for activity that occurs under your account.
You must not share authentication credentials or attempt to access accounts that do not belong to you.
ELM-HQ may use reasonable account-protection measures, including device verification, session security controls, abuse detection systems, and behavioral analysis.
Acceptable Use
You must not use the Services for activities that include, but are not limited to:
- illegal activity
- harassment, threats, or abuse of other users
- spam or unsolicited messaging
- impersonation of another person or organization
- distribution of malicious software or harmful content
- attempts to interfere with the operation or security of the platform
- attempts to access systems, accounts, or data without authorization
- attempts to exploit scoring systems, credits, challenges, or platform mechanics
Violations may result in content removal, feature restrictions, suspension, or termination of the account.
User Content
You retain ownership of the content you create across the Services.
By submitting content through the platform, you grant ELM-HQ a limited technical right to store, process, transmit, and display that content only as needed to operate, secure, and improve the Services.
You are responsible for the content you publish or share and for making sure that content complies with applicable law and these Terms.
The Services do not claim ownership of your content.
Community Areas (Spaces and Viewsly Features)
The Services may include community areas such as Spaces in ELM and interactive features such as Viewsly challenges, feeds, and similar systems.
ELM-HQ reserves the right to:
- remove content
- restrict access
- limit participation
- enforce visibility rules, including private or hard-invite areas
Community administrators or moderators may also apply additional rules within their own communities.
Viewsly Systems (Challenges, Scoring, Credits)
Viewsly may include interactive systems such as:
- challenges
- scoring systems
- reactions and engagement tracking
- credit-based features
You must not:
- artificially inflate scores or engagement
- use automation, bots, or scripts
- coordinate manipulation, including group boosting
- abuse rewards or incentives
- create duplicate or fake accounts for advantage
ELM-HQ reserves the right to:
- adjust or reset scores
- remove or revoke credits
- invalidate participation
- restrict or disable features
- suspend or terminate accounts involved in abuse
Leaderboard positions, rankings, and rewards are not guaranteed and may be recalculated, modified, or reset at any time.
Creator Protection and Content Ownership Enforcement
ELM-HQ may operate systems designed to protect original creators and platform integrity, including:
- content fingerprinting
- invisible watermarking
- per-user content tracing
- upload matching and blocking
- identity verification systems
Content identified as stolen, reuploaded without permission, or used to impersonate a creator may be:
- removed without notice
- blocked from upload
- linked to the original creator
If monetization is enabled, then:
- earnings may be frozen in escrow during disputes
- verified original creators may receive transferred earnings
- accounts involved in theft or impersonation may be suspended
Content Protection and No-Export Enforcement
Some content or Spaces may be protected by no-export rules.
You must not:
- bypass or attempt to bypass screenshot or recording protections
- redistribute protected content outside the platform
- copy, scrape, or archive protected content without authorization
The platform may, where supported or appropriate:
- detect screenshot or recording attempts
- log and report those attempts to content owners
- restrict or disable access to protected areas
Violations may result in immediate restriction or termination.
Purchases, Credits, and Digital Goods
Certain Services may offer:
- virtual credits
- digital goods such as stickers, themes, boosts, or feature access
- subscriptions or premium access
All purchases are:
- non-transferable
- non-redeemable for cash
- tied to the user account that made the purchase
Digital items may be modified, revoked, replaced, or discontinued at any time.
Subscriptions and Billing
Subscriptions may:
- automatically renew unless canceled
- be managed through the relevant platform provider, such as Apple or Google
- require cancellation before renewal to avoid additional charges
Payments are processed through third-party platform providers.
ELM-HQ does not store payment card information.
Refunds
All purchases made within ELM-HQ Services, including ELM and Viewsly, are generally final.
Virtual items such as credits, digital goods, boosts, themes, or feature unlocks are non-refundable.
Refunds will not be provided in the following cases:
- credits have been used, partially used, or consumed
- digital goods or features have been accessed, delivered, or activated
- an account is deleted after purchase
- dissatisfaction with features, rankings, or outcomes within the Services
- loss of access due to a violation of these Terms
Credits and digital items:
- have no real-world monetary value
- are non-transferable
- cannot be exchanged for currency
Refunds are handled through the platform where the purchase was made, such as the Apple App Store or Google Play.
ELM-HQ does not process payments directly and cannot issue refunds outside those platforms.
Exceptions
In limited cases, a refund or restoration may be considered where:
- a purchase was completed but the item was not delivered due to a technical failure
- duplicate charges occurred because of a system error
In those cases, ELM-HQ may:
- restore the missing purchase, or
- advise you to request a refund through the platform provider
Where required by applicable law, refunds may be issued.
Chargebacks and Abuse
Abuse of refunds or chargebacks may result in:
- suspension or termination of the account
- removal of associated credits or digital items
- restriction from future purchases
ELM-HQ reserves the right to investigate and act on suspicious refund activity.
Account Suspension and Termination
ELM-HQ may suspend or terminate accounts that:
- violate these Terms
- abuse platform systems
- engage in harassment or illegal activity
- bypass protections or safeguards
Termination may occur without notice where necessary to protect the Services, users, creators, or platform integrity.
Service Availability
The Services are provided "as is" and "as available."
Features may be changed, limited, interrupted, or removed at any time.
Limitation of Liability
To the maximum extent permitted by law, ELM-HQ is not liable for damages arising from use of the Services.

ELM Account Deletion and Data Removal Policy

Introduction
ELM-HQ Services allow users to permanently delete their account and associated data, subject to technical, legal, and safety constraints.
Account deletion removes access to the account and disables further use of the associated identifier.
How to Delete Your Account
You may be able to delete your account directly inside the application through account settings.

Automatic Removal of Unused Accounts
Accounts that have never been used may be automatically removed.
Accounts that are not activated or used within 7 days may be deleted.
Inactive Accounts
Accounts that remain inactive for extended periods, such as 12 months or longer, may be removed or anonymized.
What Happens When an Account Is Deleted
When an account is deleted:
- authentication credentials are permanently disabled
- account identifiers become inactive
- access to messages, content, and Services is revoked
Deleted accounts cannot be restored.
