ELM Terms of Service

Last updated: October 18, 2026

Introduction

These Terms of Service apply when you create an account, access, or use ELM, Viewsly, ELM.social, or any application, service, or platform developed or operated by ELM-HQ (together, the "Services").

By using the Services, you agree to comply with these Terms. If you do not agree, you must not use the Services.

Eligibility

You must be at least 13 years old, or the minimum age required by the laws of your country, to use the Services.

Some areas of the Services, including 18+ Spaces or other restricted content areas, may require you to be 18 years of age or older. By entering or using those areas, you confirm that you meet the required age.

Accounts

To use the Services, you may need to create an account identified by an ELM PIN or another system-generated identifier, depending on the application.

You are responsible for maintaining the security of your account and for activity that occurs under your account.

You must not share authentication credentials or attempt to access accounts that do not belong to you.

ELM-HQ may use reasonable account-protection measures, including device verification, session security controls, abuse detection systems, and behavioral analysis.

Public names for profiles and Spaces

Creator profiles and Spaces share one public-name namespace. A name already assigned under /creator/ cannot be separately claimed under /space/, or vice versa. A public URL name is a platform identifier, not proof of identity, endorsement, trademark ownership, or a permanent entitlement to that name.

Do not impersonate another person or organisation or misrepresent an official relationship. ELM-HQ may reserve, decline, or reassign a public URL name, including after registration, following a substantiated request by a recognised person, organisation, or authorised representative. We review identity, authority, evidence, context, and legitimate existing use; a matching name or greater popularity alone does not automatically establish a claim.

Submit a disputed-name request through Support's impersonation/reporting flow with the affected URL and evidence of your authority. Decisions require review. Where appropriate, we notify the existing holder, allow a response or appeal, and explain any change. A name change does not transfer that holder's account, messages, followers, credits, or content to the claimant. Hidden Spaces remain subject to applicable platform safety rules; making one visible must pass the same public-approval checks as a newly visible Space.

Acceptable Use

You must not use the Services for activities that include, but are not limited to:

• illegal activity
• harassment, threats, or abuse of other users
• spam or unsolicited messaging
• impersonation of another person or organization
• distribution of malicious software or harmful content
• attempts to interfere with the operation or security of the platform
• attempts to access systems, accounts, or data without authorization
• attempts to exploit scoring systems, credits, challenges, or platform mechanics

Violations may result in content removal, feature restrictions, suspension, or termination of the account.

User Content

You retain ownership of the content you create across the Services.

By submitting content through the platform, you grant ELM-HQ a limited technical right to store, process, transmit, and display that content only as needed to operate, secure, and improve the Services.

You are responsible for the content you publish or share and for making sure that content complies with applicable law and these Terms.

The Services do not claim ownership of your content.

Community Areas (Spaces and Viewsly Features)

The Services may include community areas such as Spaces in ELM and interactive features such as Viewsly challenges, feeds, and similar systems.

ELM-HQ reserves the right to:

• remove content
• restrict access
• limit participation
• enforce visibility rules, including private or hard-invite areas

Community administrators or moderators may also apply additional rules within their own communities.

Viewsly Systems (Challenges, Scoring, Credits)

Viewsly may include interactive systems such as:

• challenges
• scoring systems
• reactions and engagement tracking
• credit-based features

You must not:

• artificially inflate scores or engagement
• use automation, bots, or scripts
• coordinate manipulation, including group boosting
• abuse rewards or incentives
• create duplicate or fake accounts for advantage

ELM-HQ reserves the right to:

• adjust or reset scores
• remove or revoke credits
• invalidate participation
• restrict or disable features
• suspend or terminate accounts involved in abuse

Leaderboard positions, rankings, and rewards are not guaranteed and may be recalculated, modified, or reset at any time.

Creator Protection and Content Ownership Enforcement

ELM-HQ may operate systems designed to protect original creators and platform integrity, including:

• content fingerprinting
• invisible watermarking
• per-user content tracing
• upload matching and blocking
• identity verification systems

Content identified as stolen, reuploaded without permission, or used to impersonate a creator may be:

• removed without notice
• blocked from upload
• linked to the original creator

If monetization is enabled, then:

• earnings may be frozen in escrow during disputes
• verified original creators may receive transferred earnings
• accounts involved in theft or impersonation may be suspended

Content Protection and No-Export Enforcement

Some content or Spaces may be protected by no-export rules.

You must not:

• bypass or attempt to bypass screenshot or recording protections
• redistribute protected content outside the platform
• copy, scrape, or archive protected content without authorization

The platform may, where supported or appropriate:

• detect screenshot or recording attempts
• log and report those attempts to content owners
• restrict or disable access to protected areas

Violations may result in immediate restriction or termination.

Purchases, Credits, and Digital Goods

Certain Services may offer:

• virtual credits
• digital goods such as stickers, themes, boosts, or feature access
• subscriptions or premium access

All purchases are:

• non-transferable
• non-redeemable for cash
• tied to the user account that made the purchase

Digital items may be modified, revoked, replaced, or discontinued at any time.

Subscriptions and Billing

Subscriptions may:

• automatically renew unless canceled
• be managed through the relevant platform provider, such as Apple or Google
• require cancellation before renewal to avoid additional charges

Payments are processed through third-party platform providers.

ELM-HQ does not store payment card information.

Refunds

All purchases made within ELM-HQ Services, including ELM and Viewsly, are generally final.

Virtual items such as credits, digital goods, boosts, themes, or feature unlocks are non-refundable.

Refunds will not be provided in the following cases:

• credits have been used, partially used, or consumed
• digital goods or features have been accessed, delivered, or activated
• an account is deleted after purchase
• dissatisfaction with features, rankings, or outcomes within the Services
• loss of access due to a violation of these Terms

Credits and digital items:

• have no real-world monetary value
• are non-transferable
• cannot be exchanged for currency

Refunds are handled through the platform where the purchase was made, such as the Apple App Store or Google Play.

ELM-HQ does not process payments directly and cannot issue refunds outside those platforms.

Exceptions

In limited cases, a refund or restoration may be considered where:

• a purchase was completed but the item was not delivered due to a technical failure
• duplicate charges occurred because of a system error

In those cases, ELM-HQ may:

• restore the missing purchase, or
• advise you to request a refund through the platform provider

Where required by applicable law, refunds may be issued.

Chargebacks and Abuse

Abuse of refunds or chargebacks may result in:

• suspension or termination of the account
• removal of associated credits or digital items
• restriction from future purchases

ELM-HQ reserves the right to investigate and act on suspicious refund activity.

Account Suspension and Termination

ELM-HQ may suspend or terminate accounts that:

• violate these Terms
• abuse platform systems
• engage in harassment or illegal activity
• bypass protections or safeguards

Termination may occur without notice where necessary to protect the Services, users, creators, or platform integrity.

Service Availability

The Services are provided "as is" and "as available."

Features may be changed, limited, interrupted, or removed at any time.

Limitation of Liability

To the maximum extent permitted by law, ELM-HQ is not liable for damages arising from use of the Services.

You are responsible for your own content, conduct, and interactions on the platform.

Changes to These Terms

These Terms may be updated periodically.

Your continued use of the Services after an update constitutes acceptance of the revised Terms.

ELM Privacy Policy

Last updated: June 21, 2026

Introduction

ELM, Viewsly, ELM.social, and related ELM-HQ Services are designed with a privacy-first approach.

This Privacy Policy explains the categories of information we collect, how that information is used across ELM-HQ Services, and the controls available to users.

Unified Account Identity (ELM ID)

ELM-HQ Services use a unified account system.

An ELM identifier, such as an ELM PIN or internal account ID, may be used across multiple ELM-HQ applications, including ELM and Viewsly.

This allows users to:

• access multiple Services using one account
• maintain continuity of identity across applications
• support consistent security and authentication

This shared identity system is used for authentication, service operation, abuse prevention, and platform integrity. It is not intended to expose additional personal information to other users.

Cross-Service Enforcement

To maintain safety and platform integrity, ELM-HQ may apply enforcement actions across multiple Services.

This may include:

• account restrictions
• feature limitations
• suspensions or bans

Action taken on one ELM-HQ Service may apply to another ELM-HQ Service where reasonably necessary to prevent abuse, fraud, security risks, or repeat misconduct.

Such enforcement is applied proportionally and only where required to protect the platform and its users.

Reputation and Trust Signals

ELM-HQ Services may use internal reputation or trust systems to improve platform integrity and user experience.

These systems may include:

• engagement quality signals
• abuse detection indicators
• scoring or ranking systems, including Viewsly scoring
• interaction-based trust signals

These signals:

• are used internally for service operation and safety
• are not sold to third parties
• may influence feature access, visibility, ranking, or moderation decisions within the Services

We may collect and use:

• ELM PINs and other account identifiers
• device identifiers, including CID
• session tokens
• account status flags

User Content

We may process content you create or share through the Services, including:

• media
• posts
• comments
• challenge submissions

This information is used only to operate, secure, moderate, and improve the Services.

Technical Data

We may collect limited technical data such as:

• connection data
• timestamps
• request logs

This information is used for security, reliability, troubleshooting, and abuse prevention.

Content Protection Systems

To protect creators and platform integrity, the Services may process content using:

• fingerprinting systems
• watermarking
• duplicate detection
• abuse detection tools

These systems operate for security, protection, moderation, and rights-enforcement purposes only.

Age-Restricted Content Handling

Certain areas of the Services may be age-restricted, including 18+ areas.

Access may be controlled through:

• account flags
• device or session validation
• enforcement systems

Users are responsible for complying with age requirements that apply in their region.

Information We Do Not Sell or Use for Behavioral Advertising

ELM-HQ does not use this policy to authorize the following:

• sale of user data
• behavioral advertising based on user message content
• cross-app tracking outside ELM-HQ Services
• message profiling for advertising purposes

How Information Is Used

Information covered by this Policy may be used for:

• authentication across ELM-HQ Services
• content delivery and feature operation
• abuse prevention and fraud detection
• creator protection
• platform integrity and trust systems
• enforcement of platform rules
• service reliability and support

Data Storage and Security

Data is protected through encryption, access controls, and internal security measures appropriate to the service environment.

Data Retention

Data is retained only for as long as reasonably necessary to operate the Services, protect the platform, meet legal obligations, or complete deletion workflows.

Account deletion and related removal practices follow the applicable deletion policy.

Third-Party Authentication

The Services may support sign-in through:

• Apple Sign In
• Google Sign In

Only the authentication data necessary to complete login, session handling, and account security is used.

User Rights and Controls

Depending on the Service and your account state, you may be able to:

• delete your account
• manage privacy settings
• remove content you have shared

Additional requests may be directed to ELM-HQ using the contact details below.

ELM Security Overview

Last updated: June 21, 2026

Introduction

ELM-HQ Services are built to prioritize strong security, limited exposure, and practical safeguards across messaging, community, media, and account systems.

This overview summarizes the security principles and protections used across ELM, Viewsly, ELM.social, and related ELM-HQ Services.

Security Philosophy

ELM-HQ aims to reduce unnecessary exposure of user data and platform systems while maintaining usable, secure products.

Identity Model

Public identifiers, such as ELM PINs, are separated from internal system identifiers where practical.

This helps reduce unnecessary exposure of internal account references.

Authentication

Secure sessions may be tied to device identity signals, including CID, to help detect unauthorized account access and protect session integrity.

Encryption

Data is protected in transit and at rest using encryption and related security controls appropriate to the service environment.

Security Architecture

Central validation and service-side controls help ensure requests are authenticated, authorized, and checked for abuse where applicable.

Abuse Prevention

Platform protection measures may include:

• rate limiting
• system monitoring
• automated abuse detection
• manual moderation and review tools

Platform Integrity Protections

Additional integrity protections may include:

• detection of abnormal behavior
• prevention of automation abuse
• challenge, ranking, and scoring validation systems
• monitoring for suspicious account or content activity

Responsible Disclosure

If you believe you have found a security issue or vulnerability, please report it to:

contact@elm-hq.com

Please do not use vulnerabilities to access data, disrupt service, or affect other users.

Continuous Improvement

Security protections are reviewed and updated on an ongoing basis as the Services evolve.

ELM Account Deletion and Data Removal Policy

Last updated: June 21, 2026

Introduction

ELM-HQ Services allow users to permanently delete their account and associated data, subject to technical, legal, and safety constraints.

Account deletion removes access to the account and disables further use of the associated identifier.

How to Delete Your Account

You may be able to delete your account directly inside the application through account settings.

If you cannot access that setting or cannot access your account, you may request deletion by contacting:

contact@elm-hq.com

Automatic Removal of Unused Accounts

Accounts that have never been used may be automatically removed.

Accounts that are not activated or used within 7 days may be deleted.

Inactive Accounts

Accounts that remain inactive for extended periods, such as 12 months or longer, may be removed or anonymized.

What Happens When an Account Is Deleted

When an account is deleted:

• authentication credentials are permanently disabled
• account identifiers become inactive
• access to messages, content, and Services is revoked

Deleted accounts cannot be restored.

Data Removal

Account-related data is removed or anonymized where technically possible.

Some information may be retained temporarily for:

• security investigations
• abuse prevention
• legal obligations

Content Shared With Other Users

Content previously shared with other users may remain visible unless it is removed before account deletion or unless later removal is technically or legally required.

Processing Time

Deletion requests are processed within a reasonable timeframe. Timing may vary depending on account status, technical dependencies, and safety review requirements.
